importance of DRT
The primary goal and function of DRT is to recover money owed to banks and other financial institutions from borrowers. The Tribunal’s authority is restricted to resolving disputes involving the recovery of unpaid sums from NPAs that banks have declared in accordance with RBI criteria. The Tribunal is granted all of the District Court’s authority. A recovery officer is another employee of the Tribunal who aids in the execution of recovery Certificates approved by the presiding officers. DRT adheres to the law by placing a strong emphasis on swift case resolution and prompt implementation of the decision.
Applicability of the act
The following organisations are covered by the Debt Recovery Tribunals Act.
- All of India is covered by it, with the exception of Jammu & Kashmir State.
- It is applicable when the outstanding debt is at least Rs. 10,000,000.
- It applies when only banks and financial institutions submit the initial claim for the recovery of debts.
Document required
Each application must be submitted with a paper book containing information such as
- A statement provides information about the debt owed to a respondent as well as the circumstances under which it became due.
- All records cited in the application as well as those on which the applicant has relied.
- Information, such as a crossed Indian Postal Order or Bank Draft indicating the application fee.
- An index of the forthcoming documents.
Application fee
Every application must include the fee specified in the sub-rule (2).
- The fee may be paid in cash at the Registrar’s office or in the form of a crossed demand draught written in the Registrar’s favour.
- A crossed Indian Postal Order made out to the Registrar and payable at the Central Post Office of the station where the Tribunal is located can be used to pay the fee.
dRT process
When submitting an application to the Debt Recovery Tribunal, the following steps must be taken:
procedure for filing
The applicant should submit their application to the Registrar under whose authority they are currently operating as a bank or other financial institution.
Applications must be submitted in the format required.
The applicant, his agent, or a qualified legal professional may present the application.
The application must be handed in person to the registrar of the tribunal whose jurisdiction his case falls under or it may be submitted by registered mail with the registrar’s address on it.

If the application sent by mail is regarded as having been delivered to the registrar on the same day that the registrar received the request.
Two sets of the application should be submitted. a file-size envelope that is empty but has the respondent’s whole address on it. Each respondent’s complete bearing address must be provided by the applicant.
presentation & verification of application
Every application will be approved on the date it is presented or deemed to have been filed in accordance with that regulation, and the registrar or another relevant person authorised by him should sign the endorsement.If the application is confirmed to be in order and given a serial number, it should be properly registered.
issuance of original application number
The overall administration of the tribunal is under the control of the DRT Registrar. After confirming the application, the Registrar will issue the Original Application (OA) number and summons. Additionally, each respondent receives a copy of the application and a paper book. Within one month (or an extension granted by the tribunal) of receiving the application, the respondent may submit four complete sets containing the application’s response and supporting documentation.
